Es können nur fabrikneue Waren ggf. Leistungen ausgestellt werden. Gebrauchtmaschinen und der Handel mit Gebrauchtmaschinen werden nicht zugelassen. Von den Ausstellern sind in der Anmeldung die vorgesehenen Exponate den Kennziffern der Produktkategorien und damit zugleich den Angebotsbereichen zuzuordnen. Können Exponate mehreren Angebotsbereichen zugeordnet werden, sind Anmeldungen unter den jeweiligen Kennziffern vorzunehmen. Nur mit Kennziffern angemeldete Produkte können zugelassen und ausgestellt werden. Texte in der Anmeldung, die von den Kennziffern der Produktkategorien (Teil B der Ausstellereinladung) abweichen, werden nicht berücksichtigt. Präsentationen von Produkten und Leistungen aus den unterschiedlichen o.g. Produktgruppen können grundsätzlich nicht zusammen auf einem Stand ausgestellt werden. Wohnmobile, Caravans, allgemeine Fahrräder, Motorräder sowie jegliche Art von Fahrzeugen (wie PKW, Zugfahrzeuge, Busse usw.) gehören nicht dem Warenangebot der boot Düsseldorf 2014 an und dürfen auch nicht zwecks Demonstration, Dekoration oder als Standgestaltungselemente bzw. zur Vorführung auf dem Messestand gezeigt werden. Bei Booten, die bestimmungsgemäß mit Außenbordmotoren ausgerüstet werden, ist das Ausstellen von Außenbordmotoren nur in direkter Verbindung mit dem Boot zulässig. Das Ausstellen weiterer Motoren ist nicht zulässig. Es ist ein Komplettpreis anzugeben, der den Preis von Motor und Boot einschließt.

Unless special arrangements have been made with haulage contractors, all boats exceeding 10 metres in length or a total weight over 9 tonnes must be on Messe Düsseldorf site 5 days before the show opens.

Newly manufactured products_old only will be permitted as exhibits. Secondhand machinery and agents for second-hand machinery will not be admitted to the exhibition. Exhibitors are required to list on their application form the product codes from the Product categories which correspond with the goods they intend to show and at the same time to select the appropriate product section. If exhibits fall under more than one product section then these should all be listed on the application form. Only products_old with a listed product code can be admitted and exhibited. Texts on application forms that deviate from the product codes in the Product categories (Part B of the Exhibitor Invitation) will not be considered. products_old and services from different product groups listed above may not be exhibited/pre-sented at the same stand. Mobile homes, caravans, allround cycles and motorcycles and vehicles of all types (cars, towing vehicles, buses etc.) are not part of the boot Düsseldorf 2014 exhibit range and may not be used for demonstration or decorative purposes, as stand design elements or for presentation at stands. In the case of boats stipulated as fitted with outboard engines, such engines may only be exhibited together with the boat. Other engines may not be exhibited. The price quoted must be the total price for engine and boat. Trade of new products_old is only permitted if a similar replacement product can be displayed immediately, with the exception of boats over 25 m. As far as the exhibits are concerned, the ordi-

S‘il n‘a pas été établi de conventions spéciales avec les transporteurs, les bateaux d‘une longueur supérieure à 10 mètres resp. d‘un poids total de plus de 9 tonnes devront être sur le parc des expositions de Düsseldorf 5 jours avant l‘ouverture du salon.

Seules les marchandises neuves peuvent être exposées. Les machines d’occasion et le commerce de machines d’occasion ne sont pas autorisés. Lors de leur inscription, les exposants doivent indiquer les produits qu’ils prévoient d’expo-ser en les classant d’après les codes de référence des catégories de produits, choisissant ainsi les groupes de produits appropriés. Si les produits exposés sont susceptibles d’être classés sous plusieurs groupes de produits, il faut les inscrire avec les codes de référence correspondants. Seuls les produits inscrits avec leurs codes de référence pourront être acceptés et exposés. Il ne sera pas tenu compte dans le formulaire d’inscription de mentions autres que les codes de référence des catégories de produits (Partie B de l’invitation exposants). Par principe, les présentations de produits et de prestations issus des différents groupes d‘articles mentionnés plus haut ne peuvent pas être exposées ensemble sur un stand. Les camping-cars, caravanes, bicyclettes générales, motos ainsi que tous les types de véhicules (comme les voitures, les véhicules de traction, les cars etc.) ne font pas partie de la palette d‘offre de boot Düsseldorf 2014; leur exposition sur les stands du salon est interdite, même pour des présentations ou en tant que décoration ou des éléments de configuration du stand ou bien dans des buts de démonstration sur le stand. Aussteller, die nicht an der letzten Veranstaltung teilgenommen haben, zahlen ! 15,00/m² Vorkasse. Dies wird nach der Veranstaltung mit den tatsächlich bestellten Leistungen abgerechnet. Für den Ausstellungs- und Messe-Ausschuss der Deutschen Wirtschaft e.V. (AUMA) wird zusätzlich ein Betrag von ! 0,60 je Quadratmeter erhoben.

The media-flat rate to be paid by every exhibitor serves the publishing of the exhibitor data in the electronic media and possibly other media along with use of the event’s Internet page by the exhibitors.
Charges for services are printed on the respective order forms. An advance payment for these services will be charged on the basis of the amount charged for the last event. Exhibitors who did not participate in the latest event shall have to make such advance payment in the amount of ! 15.00 per square metre. After-fair settlement of accounts shall be based on services actually ordered. An additional charge of € 0.60 per m² is levied as a contribution to the Confederation of German Trade Fair and Exhibition Industries (AUMA).

Le forfait médias que chaque exposant doit payer sert à publier les informations concernant les exposants dans les médias électroniques et éventuellement dans d’autres supports presse, ainsi que pour l‘exposant, à utiliser la page Internet du salon.
Les frais liés aux prestations de service figurent sur les bons de commande correspondants. Pour ces services, il vous sera demandé un paiement d’avance équivalent au montant des prestations facturé lors de la dernière session. Der Beteiligungspreis schließt keine Standbegrenzungswände ein.
Der Beteiligungspreis und alle sonstigen Entgelte werden in Euro berechnet und sind Nettopreise, neben denen die Umsatzsteuer in der jeweils für den Zeitpunkt der Veranstaltung gesetzlich festgesetzten Höhe berechnet wird und zu entrichten ist, sofern nicht gesetzlich etwas anderes bestimmt ist.

8 Ausstellerausweise
Die Ausstellerausweise (siehe Nr. 7 der Besonderen Bedingungen) sind ausschließlich für die Aussteller, deren Standpersonal und Standbeauftragte bestimmt. Bei Missbrauch wird die Karte ersatzlos eingezogen. Jeder Aussteller erhält für einen Stand bis 20 m² Größe 3 Ausstellerausweise kostenlos. Für jede weiteren angefangenen 20 m² wird ein weiterer Ausstellerausweis bis zur Höchstzahl von 50 kostenlos zur Verfügung gestellt. Zusätzliche kostenpflichtige Ausstellerausweise können zu gegebener Zeit bei der Messegesellschaft bestellt werden. Für jeden Mitaussteller werden nach Zahlung der Mitausstellergebühr 2 Ausstellerausweise kostenlos zur Verfügung gestellt.
Es gilt das Recht der Bundesrepublik Deutschland.

März 2013 Messe Düsseldorf GmbH The regular minimum stand space in the halls 4, 5, 6, 9, 10, 15, 16, 17 is 20 m². The regular minimum stand space in the halls 2, 3, 7a, 7.0, 11, 12, 13, 14 is 12 m². Smaller areas are possible only if they become available during hall planning. Space will be provided in units of a square metre. Part of a square metre will be charged as a full unit. In computing the charge for space that is not rectangular, the area making up a rectangle will be included. Projections, pillars, columns and space for installation connections will all be included in space costs.
The participation fee does not include any stand demarcation walls.
The participation and all other charges will be calculated in Euro. These are net prices and sales tax, calculated at the legally fixed rate at the time of the event, is payable in addition, is payable in addition,unless there are other legal provisions.

8 Exhibitor passes
The exhibitor passes (see No. 7 of the Special Conditions of Participation) are exclusively for the exhibitor, his/her stand staff and representatives. In the case of misuse the passes will be withdrawn without replacement. Every exhibitor will receive 3 exhibitor passes, free of charge, for a stand measuring up to 20 m². One extra exhibitor pass will be made available for each additional 20 m², or part thereof, up to a maximum of 50 passes. Additional exhibitor passes for which the exhibitor will be invoiced can be ordered from Messe Düsseldorf in due course. 2 exhibitor passes, free of charge, will be made available to each co-exhibitor on payment of the co-exhibitor fee.

Un supplément d’€ 0,60 par m² sera perçu au bénéfice de l’Ausstellungs- und Messe-Auss-chuss der Deutschen Wirtschaft e.V. (AUMA) (Comité des Foires et Expositions Commerciales et Techniques allemandes). La surface minimum d’un stand dans les halls 4, 5, 6, 9, 10, 15, 16, 17 est de 20 m². La surface minimum d’un stand dans les halls 2, 3, 7a, 7.0, 11, 12, 13, 14 est de 12 m². Les stands d’une surface inférieure à 20 m² ne seront attribués que dans la mesure où de telles surfaces se dégagent de la planification. Toute fraction de m² entamé sera comptabilisée comme m² entier. Toutes les surfaces qui n’ont pas de côtés au carré seront facturées comme si tous les angles faisaient 90°. Avancées, poteaux, piliers et surfaces réservées aux raccordements des installations sont également facturés.
Le prix de location ne comprend pas les cloisons de stands.
Le prix de location et tous les autres frais seront facturés en Euro en prix nets sur lequels sera facturée la TVA au taux en vigueur au moment où se tiendra la manifestation, sauf indication contraire par la loi.

8 Badges exposants
Les badges des exposants (voir le point 7 des conditions particulières de participation) seront réservés exclusivement aux exposants, au personnel de leur stand et à leurs répresentants. En cas d’usage abusif, le badge sera retiré sans indemnisation. Chaque exposant reçoit pour un stand jusqu’à 20 m² de surface 3 badges exposants. Pour chaque tranche de 20 m² supplémentaire, il reçoit un badge supplémentaire et ainsi de suite jusqu’à un maximum de 50 badges gratuits. Des badges supplémentaires peuvent etre commandés par écrit en temps utile auprès de Messe Düsseldorf. Chaque co-exposant reçoit, après paiement du forfait de co-exposant, 2 badges gratuits.

1 Anmeldung
Die Anmeldung ist auf dem für die Veranstaltung vorgesehenen Formblatt unter Anerkennung dieser Teilnahmebedingungen, der gültigen Preislisten, ggf. speziellen Teilnahmebedingungen und der später ergehenden Technischen Richtlinien vollständig ausgefüllt und rechtsverbindlich unterschrieben einzusenden an die Messe Düsseldorf GmbH Postfach 10 10 06 40001 Düsseldorf Deutschland. Elektronische Anmeldungen sind nur verbindlich, wenn sie mit dem Namen des Erklärenden und der qualifizierten Signatur versehen sind oder mit dem Passwort des Online-Ordersystems (OOS) der Vorveranstaltung autorisiert wurden. Die Exponate sind durch Kennziffern aus dem Warenverzeichnis, bei Anlagen und Maschinen auch mit Gewicht und Höhe, genau anzugeben. Zur genauen Darstellung sind auf Verlangen der Messegesellschaft Prospekte und Produktionsbeschreibungen einzureichen. In der Anmeldung aufgeführte Bedingungen oder Vorbehalte werden nicht berücksichtigt. Besondere Platzwünsche, die nach Möglichkeit berücksichtigt werden, stellen keine Bedingung für eine Teilnahme dar. Ein Konkurrenzausschluss wird nicht zugestanden. Die Anmeldung ist verbindlich, unabhängig von der Zulassung seitens der Messegesellschaft. Die Anmeldung ist erst mit ihrem Eingang und ggf. dem Eingang des Garantiebetrages bei der Messegesellschaft vollzogen und bindend bis zur Mitteilung über die Zulassung oder endgültige Nichtzulassung. Der Eingang der Anmeldung und ggf. des Verrechnungsschecks werden bestätigt. Es wird ausdrücklich auf die Datenschutzbestimmungen der Messe Düsseldorf hingewiesen
(s. www.messe-duesseldorf.de).

Nach diesem Termin eingehende Anmeldungen werden evtl. auf die Warteliste gesetzt, sofern die jeweiligen Bereiche überbucht sein sollten. Die vom Anmelder anzugebende USt-ID-Nr. (für Anmelder aus der EU) bzw. der Nachweis der Unternehmerbescheinigung (für Anmelder aus Nicht-EU-Ländern) dient der umsatzsteuerlichen Zuordnung des Anmelders. Der Anmelder versichert, die Richtigkeit bzw. Gültigkeit der USt-ID-Nr. bzw. der Unternehmerbescheinigung und die Zuordnung zu seinem unternehmerischen Bereich. Er ist verpflichtet, evtl. Änderungen diesbezüglich der Messegesellschaft umgehend mitzuteilen. Die USt-ID-Nr. bzw. Unternehmerbescheinigung verwendet der Anmelder für seine Teilnahme an der Veranstaltung, Sie kommt auch für alle weiteren Geschäfte zwischen dem Anmelder und der Messegesellschaft zur Anwendung.

b. Application for space

Applications for space shall be made in duplicate, using only the enclosed form, acknowledging the Conditions of Participation and the subsequently issued Technical Regulations. Completed and officially signed application forms should be sent to Messe Düsseldorf GmbH Postbox 10 10 06 40001 Düsseldorf Germany. Applications which have been completed electronically are legally binding only if they have been signed in the form of an advanced electronic signature in line with the European Directive on Electronic Signatures and certified by an authorised third party or authorised with the password of the Online Order system (OOS) of the previous event. Exhibits must be annotated with the corresponding code number according to the List of Exhibits and for machinery and installations weight and height must be supplied. To ensure accurate representation Messe Düsseldorf may request that brochures and product descriptions be submitted. Applications made subject to conditions or reservations cannot be taken into consideration. Every endeavour will be made to meet requests for specific sites, but such requests cannot be recognised as a condition for participation. No under-taking can be given with respect to exclusion of competitors. The application is binding on the applicant, irrespective of whether it is accepted by Messe Düsseldorf or not. The application will only be considered effected once it has been received by Messe Düsseldorf and it is then binding until admission or final non-admission. Receipt of application and if applicable the deposit cheque will be acknowledged. Express reference is made to the data protection regulations of Düsseldorf Fair (see www.messe-duesseldorf.de).

Any applications received after this deadline may be put on a waiting list, should the areas for which an application was made be overbooked. The VAT ID No. to be stated by the exhibitor (for exhibitors applying from the EU) or verification of the entrepreneur certificate (for applicants from non-EU-countries) is necessary for purposes of VAT classification of the applicant. The applicant provides assurance that the VAT ID No. or the entrepreneur certificate along with classification for his corporate sector is correct and valid. He is obliged to immediately inform the trade fair company of any changes in this respect. The VAT ID No. or sub-certificate is used by the applicant for participation at the event, it is also used for all other business and transactions between the applicant and trade fair company.

1 Inscription

En s’inscrivant l’exposant accepte les conditions de participation, les tarifs en vigueur, les éventuelles conditions spéciales de participation et les directives techniques qui lui seront adressées ultérieurement. Les inscriptions électroniques ne sont contractuelles que si elles comportent le nom du déclarant et la signature qualifiée ou si elles ont été autorisées lors de la précédente session avec la code du système de commande en ligne (OOS). La spécification de biens d’exposition avec indication du poids et de la hauteur se fe-ra conformément aux numéros de code produit à l’intérieur des groupes de produits. Pour une présentation précise, il y a lieu de fournir, sur demande de Messe Düsseldorf, des prospectus et descriptions de produits. Il ne peut être tenu compte de conditions et de réserves faites dans les inscriptions. Les demandes spéciales d’emplacement seront prises en considération dans la mesure du possible. Elles ne pourront néanmoins être reconnues comme condition de participation. Une clause d’exclusivité ne pourra être allouée. L’inscription engage le participant indépendamment de l’admission par Messe Düsseldorf. L’inscription avec, le cas échéant, les arrhes versées n’est considérée comme enregistrée que lorsque elle est parvenue à Messe Düsseldorf. L‘inscription ne sera rendue effective qu‘à la réception des formulaires d‘inscription par Messe Düsseldorf, et préserve son caractère d‘engage-ment jusqu‘à l‘admission on la non-admission définitive. L‘enregistrement de l‘inscription et le cas échéant du chèque d‘arrhes sera confirmé par écrit. Les inscriptions arrivées après cette date seront éventuellement mises sur liste d’attente si les secteurs concernés sont surbookés. Le No de TVA que doit donner celui qui s‘ins-crit (pour une société qui est basée dans l’UE) voire, la preuve de la certification de l’entre-preneur (pour celui qui se trouve dans un pays tiers) sert à l’affectation de la TVA de celui qui s’inscrit. Celui-ci garantit l’exactitude voire, la validité du no de TVA voire, de la certification de l’entrepreneur et son affectation comme telle. Il est tenu de prévenir sans délai le salon de tout changement pouvant intervenir à ce su-jet. Celui qui s’inscrit utilise le No de TVA voire, la certification de l’entrepreneur pour participer au salon. Ce numéro servira aussi ultérieurement pour toutes les autres affaires traitées entre lui et Messe Düsseldorf.
Zulassung
Aussteller der Veranstaltung sind die Hersteller der Exponate. Handelsfirmen können nur zugelassen werden, wenn sie für die auf der Messe präsentierten Produkte und Leistungen den Nachweis erbringen, dass sie allein berechtigt sind, diese unter Ausschluss des Herstellers zu zeigen und zu vertreiben. Dadurch sollen Doppelbesetzungen mit Erzeugnissen aus der gleichen Produktion ausgeschlossen werden. Grundsätzlich werden nur Aussteller zugelassen, deren angemeldete Produkte und Leistungen dem Angebot der Veranstaltung entsprechen und die die Voraussetzungen nach Absatz 1 erfüllen. Über die Teilnahmeberechtigung von Ausstellern und Exponaten entscheidet, ggf. nach Anhörung des zuständigen Ausschusses, die Messegesellschaft. Ein Rechtsanspruch auf eine Zulassung besteht nicht. Aussteller, die ihren finanziellen Verpflichtungen der Messegesellschaft gegenüber nicht nachgekommen sind oder gegen die Teilnahmebedingungen, Technische Richtlinien oder gesetzliche Bestimmungen verstoßen haben, können von der Teilnahme ausgeschlossen werden. Die Zulassung als Aussteller mit den Ausstellungsgütern wird schriftlich bestätigt und ist nur für den darin genannten Aussteller gültig. Mit der Übersendung der Zulassung ist der Ausstellungsvertrag zwischen der Messe Düsseldorf GmbH und dem Aussteller geschlossen. Dem Aussteller werden ein Hallenplan, aus dem die Lage des Standes ersichtlich ist, und ggf. ein Geländeplan mit Kennzeichnung der Halle übersandt. Die Messegesellschaft ist berechtigt, die erteilte Zulassung zu widerrufen, wenn sie auf Grund falscher Voraussetzungen oder Angaben erteilt wurde oder die Zulassungsvoraussetzungen später entfallen. Ist die Fläche aus nicht von der Messegesellschaft verschuldetem Anlass nicht verfügbar, so hat der Aussteller Anspruch auf Rückerstattung des Beteiligungspreises. Eine Forderung auf Schadenersatz besteht nicht. Die Messegesellschaft kann, wenn es die Umstände zwingend erfordern, unter Darlegung der Gründe – abweichend von der Zulassung und unter Berücksichtigung der Zumutbarkeit für den Aussteller – einen Platz in anderer Lage zuweisen oder die Standgröße geringfügig verändern. Sie behält sich vor, die Ein- und Ausgänge zum Messegelände und zu den Hallen sowie die Durchgänge zu verlegen.
Zahlungsbedingungen
Die Teilnahmerechnung wird dem Aussteller gleichzeitig mit oder nach der Zulassung und der Platzzuteilung zugestellt. Beanstandungen sind unverzüglich nach Empfang der Rechnung schriftlich geltend zu machen. Spätere Einwendungen werden nicht mehr anerkannt. Alle von der Messegesellschaft erstellten Teilnahmerechnungen sind sofort ohne Abzug mit Rechnungsdatum fällig. Rechnungen über sonstige Leistungen oder Lieferungen, die gesondert in Auftrag gegeben werden, sind mit Rechnungsdatum fällig, d.h. in der Regel vor Beginn der Veranstaltung, spätestens jedoch ab Leis-tungs- und Lieferzeitpunkt. Werden Rechnungen auf Weisung des Ausstellers an einen Dritten gesandt, so bleibt der Aussteller gleichwohl Schuldner. Einzahlungen unter Angabe der Rechnungsnummer und Hinweis auf die Veranstaltung erbeten an:
Admission
Exhibitors at the event are the manufacturers of the products_old. Trading companies will only be admitted if they can provide proof from the manufacturer that they are authorised to display and sell those particular products_old and services at the show, i.e. the manufacturing company cannot exhibit in addition. This is to preclude the possibility of the same product being exhibited twice. In principle, only those exhibitors are admitted whose registered exhibits and services are in accordance with the event’s List of Exhibits and meet the requirements stated in paragraph 1. The decision as to whether an exhibitor or exhibits can be admitted rests with Messe Düsseldorf, if necessary after consultation with the Admissions Committee. A legal claim for admission does not exist. Exhibitors who have not fulfilled their financial obligations to Messe Düsseldorf or have contravened the Conditions of Participation, the Technical Regulations or legal requirements can be excluded from participation. Exhibitors will receive written confirmation that they have been admitted with their products_old. This confirmation applies only to the designated exhibitor. Notification of admission constitutes the conclusion of the contract between Messe Düsseldorf GmbH and the applicant. The exhibitor will be sent a hall plan showing the location of the stand and where relevant a site plan indicating the hall. Messe Düsseldorf reserves the right to cancel a stand booking approved on the basis of misleading or false information or if the requirements for participation are no longer met or the booking is no longer in accordance with the admission regulations. If the allotted space is not available for reasons beyond the control of Messe Düsseldorf the exhibitor may claim a refund of the space rental cost; no claims for damage will be entertained. Messe Düsseldorf may, if required by circumstances and specifying its reasons for doing so, and bearing in mind what is reasonable for the exhibitor, deviate from the notice of admission by allocating space in an-other position or reducing or increasing the stand size. It reserves the right to alter entrances and exits to and from the exhibition grounds and the halls, as well as throughways between halls.
Terms of payment
The invoice for participation charges will be sent to the exhibitor together with, or subsequent to, the confirmation of admission and the allocation of space. All complaints must be submitted in writing immediately upon receipt of the invoice. Objections raised at a later date shall not be taken into consideration. Upon receipt of the invoice for participation charges issued by Messe Düsseldorf it is payable immediately without deduction. Invoices for miscellaneous services or supplies ordered separately are payable with immediate effect,
i.e. usually before the relevant show commences, but at the latest at the time the service is provided or the items supplied. If the exhibitor gives instructions to render accounts to a third party, the exhibitor still remains the debitor. Remittances should be endorsed with the invoice number, marked the event and made payable to:
Admission
Les exposants de la manifestation sont les fabricants des produits exposés. Les entreprises commerciales ne sont admises que si elles peuvent apporter la preuve qu’elles seules sont autorisées à présenter et à vendre les produits et services à l’exclusion du fabricant. Cette clause doit exclure toute double attribution avec des produits provenant d’une même production. En principe seuls sont admis les exposants dont les produits et services déclarés correspondent à l’offre de la manifestation et qui remplissent les conditions du paragraphe 1. Messe Düsseldorf décide de l’autorisation de participation des exposants et des produits exposés, le cas échéant après audition de la commission compétente. On ne peut faire valoir aucun droit à l’admission. Les exposants n’ayant pas rempli leurs obligations financières vis-à-vis de la Messegesellschaft ou qui auraient contrevenu aux conditions de participation, aux directives techniques ou aux dispositions légales pourront être exclus de la participation. L‘admission au titre d‘exposant - et des produits - est confirmée par écrit et n‘est valable que pour l‘exposant expressément mentionné. Cette admission conclut le contrat entre Messe Düsseldorf GmbH et l‘exposant. On remettra à l‘exposant un plan des halls avec l‘emplacement de son stand et éventuellement un plan du parc des expositions indiquant l‘emplacement du hall. Messe Düsseldorf se réserve le droit de retirer une admission si celle-ci a été accordée sur une base erronée ou si les conditions régissant la participation sont caduques. Si la surface n‘est pas disponible pour des raisons indépendantes de Messe Düsseldorf, les frais de participation sont intégralement remboursés à l‘exposant qui ne peut cependant prétendre à une indemnité. Messe Düsseldorf peut le cas échéant et suite à une impossibilité proposer à l‘exposant un autre emplacement ou modifier légèrement la taille du stand à condition d‘en expliciter les raisons et de ne pas léser les intérêts de l‘exposant. Elle se réserve le droit de modifier les accès au parc des expositions et aux halls ainsi que les couloirs.
Conditions de paiement
La facture avec le prix de la location est envoyée à l’exposant automatiquement avec ou après son admission et son attribution de stand. Les réclamations sont à formuler immédiatement après réception de la facture par écrit. Les réclamations nous parvenant plus tard ne seront pas prises en compte. Toutes factures émises par Messe Düsseldorf au titre de la participation sont payables sans es-compte à réception. Les factures émises après la facturation principale de location sont payables immédiatement en totalité. Des factures relatives à des prestations diverses ou à des livraisons, commandées à part, sont à payer immédiatement, c’est-à-dire avant le début de Messe Düsseldorf, et au plus tard au moment de la livraison ou de l’exécution de la prestation. Si l’exposant donne instruction d’établir des factures pour le compte d’un tiers, son

Alle Rechnungen sind 30 Tage nach Fälligkeit und erteilter Rechnung mit 8 % über dem jeweiligen Basiszinssatz zu verzinsen. Die Messegesellschaft kann bei Nichteinhaltung der Zahlungstermine durch den Aussteller (auch we-gen der nicht vollständig bezahlten Fläche) die Kündigung hinsichtlich der gesamten zugelassenen Fläche erklären und darüber anderweitig verfügen. Hinsichtlich des Kostenersatzes gilt Nr. 5 der Bedingungen. Für alle nicht erfüllten Verpflichtungen kann die Messegesellschaft das eingebrachte Standausrüstungs- und Messegut der Aussteller auf Grund des Pfandrechts zurückbehalten. § 562a Satz 2 BGB findet keine Anwendung, sofern nicht bereits ausreichende Sicherheit besteht. Die Messegesellschaft kann, wenn die Bezahlung nicht innerhalb der gesetzten Frist erfolgt, die zurückgehaltenen Gegenstände nach schriftlicher Ankündigung freihändig verkaufen. Für Beschädigung und/oder Verlust des Pfandgutes haftet die Messegesellschaft nur bei Vorsatz oder grober Fahrlässigkeit.

4 Mitaussteller und
Gemeinschaftsstände

Ohne Genehmigung der Messegesellschaft ist es nicht gestattet, einen zugewiesenen Stand oder Teile davon gegen Entgelt oder ohne Vergütung an Dritte abzugeben. Für Waren oder Firmen, die nicht in der Zulassung genannt sind, darf auf dem Stand nicht geworben werden. Die Aufnahme eines Mitausstellers hat der Mieter schriftlich bei der Messegesellschaft zu beantragen. Der Mitaussteller unterliegt denselben Bedingungen wie der Hauptaussteller. Er hat das ausgewiesene Mitausstellerentgelt sowie eine einmalige Werbekosten- und Mediapauschale an die Messegesellschaft zu zahlen. Schuldner des Mitausstellerentgelts bleibt außerdem immer der Hauptaussteller des Standes. 30 days after their due date all invoices will attract interest at 8% above the basic interest rate. If the exhibitor does not effect payment by the date specified (even where stand space has been partially paid), Messe Düsseldorf may cancel the entire allocated stand space and dispose of it else-where. Section 5 of the Conditions of Participation is applicable with regard to refunding. For all outstanding liabilities, Messe Düsseldorf may retain the stand equipment and products_old of the relevant exhibitor as security. Sec. 562a paragraph 2 of the German Civil Code (BGB) does not apply where there is insufficient security. If payment is not made within the stipulated period Messe Düsseldorf is entitled, after written notification, to sell the retained items at their discretion. Messe Düsseldorf is not responsible for damage to and/or loss of the retained items, other than in the case of wilful intent or gross negligence.

4 Co-exhibitors and group
stands

Without the prior consent of Messe Düsseldorf, exhibitors are not permitted to give their allotted stand either fully or in part to a third party, whether for payment or free of charge. products_old or companies other than those specified on the admission slip cannot be advertised on the stand. Permission to accept co-exhibitors will be given only upon application in writing by the exhibitor to Messe Düsseldorf. The co-exhibitor is liable to the same conditions as the main exhibitor. Any co-exhibitor shall have to pay to the Messegesellschaft the co-exhibitor fee stipulated as well as a non-recurrent lump sum covering advertising costs as well as a flat charge for media. Toutes les factures seront grevées après 30 jours suivant leur date d‘échéance et d‘envoi de facture d‘un taux de 8 % supérieur au taux de base. Messe Düsseldorf se réserve le droit, en cas de non respect de délais de paiement par l’exposant (tout comme d’ailleurs en cas de paiement incomplet de la surface de stand), de prononcer la résiliation relative à la totalité de la surface du stand confirmée et d’en disposer à sa guise. En ce qui concerne le remboursement des frais, c’est le § 5 des conditions qui s’applique. Si l’exposant ne répond pas à tous ses engagements, Messe Düsseldorf pourra, en vertu du droit de gage, retenir les équipements de stand et les produits exposés apportés par l’exposant. L’article 562a, alinéa 2 du code Civil Allemand ne sera pas applicable tant qu’on ne disposera pas d’une sécurité suffisante. Si le paiment n’est pas effectué dans les délais fixés, Messe Düsseldorf pour-ra vendre à l’amiable les objets en gage après en avoir avisé l’exposant par écrit. Messe Düsseldorf déclinera toute responsabilité en cas de pertes et/ou dégâts des objets ainsi retenus en gage, sauf en cas de préméditation ou de négligence caractérisée.

4 Co-exposants et stands
collectifs

Sans autorisation de Messe Düsseldorf, il n’est pas permis de céder tout ou partie d’un stand attribué à des tiers, à titre onéreux ou gratuit. Il n’est pas permis de faire de la publicité ou d’exposer des objets d’une firme qui n’aurait pas fait l’objet d’une admission de la part de Messe Düsseldorf. L’exposant doit formuler une demande écrite auprès de Messe Düsseldorf s’il souhaite prendre sur son stand un co-exposant. Celui-ci est soumis aux mêmes règlements que l’exposant principal. Il doit régler à Messe Düsseldorf le droit de coexposant prévu et un forfait unique pour frais publicitaires et médiatiques. En outre, l’exposant principal du stand reste toujours le débiteur du montant de la participation du co-exposant. Si un exposant prend sur son stand un co-exposant sans l’autorisation de Messe Düsseldorf, celle-ci Messegesellschaft, den Vertrag mit dem Hauptaussteller fristlos zu kündigen und den Stand auf seine Kosten räumen zu lassen. Der Aussteller verzichtet insoweit auf die Rechte der verbotenen Eigenmacht. Schadensersatzansprüche stehen dem Hauptaussteller nicht zu. Mitaussteller sind alle Aussteller, die neben dem Hauptaussteller auf dem Stand ausstellen oder erscheinen. Sie gelten auch dann als Mitaussteller, wenn sie zu dem Hauptaussteller enge wirtschaftliche oder organisatorische Bindungen haben. Firmenvertreter werden als Mitaussteller nicht zugelassen. Zusätzlich vertretene Hersteller sind solche, deren Produkte auf dem Stand von dem Aussteller vertrieben werden, ohne dass der Hersteller selbst anwesend ist. Hersteller von Geräten, Maschinen oder sonstigen Erzeugnissen, die zur Demonstration des Warenangebotes eines Ausstellers erforderlich sind und nicht angeboten werden, gelten nicht als Mitaussteller. Mitaussteller können auf Grund der Eintragungsbedingungen in den Katalog mit kompletter Anschrift aufgenommen werden, sofern die Entgelte bezahlt sind und die Unterlagen termingerecht vorliegen. Größere Gemeinschaftsstände kann die Messegesellschaft genehmigen, wenn sie sich in die fachliche Gliederung der Veranstaltung einfügen lassen. Im Übrigen gelten alle Bestimmungen für jeden Aussteller. Wird ein Stand zwei oder mehreren Firmen gemeinsam zugeteilt, so haftet gegenüber der Messegesellschaft jede Firma als Gesamtschuldner. Die gemeinschaftlich ausstellenden Firmen sollen einen gemeinsamen Vertreter in der Anmeldung benennen.

5 Rücktritt und
Nichtteilnahme

Bis zur Zulassung ist der Rücktritt von der Anmeldung möglich. Ein Rücktrittsentgelt (vgl. Nr. 7 der Besonderen Teilnahmebedingungen) zuzüglich Umsatzsteuer ist zu zahlen. Nach der Zulassung ist ein Rücktritt oder eine Reduzierung der Stand-fläche durch den Aussteller nicht mehr möglich. Der gesamte Teil-nahme-betrag und die tatsächlich erbrachten Leistungen sind zu zahlen. Der Austausch von nicht belegten Flächen durch die Messegesellschaft zur Wahrung des optischen Gesamtbildes entbindet den Aussteller nicht von seiner Zahlungsverpflichtung. Verzichtet der Aussteller darauf, die ihm zugeteilte Standfläche zu belegen, und kann diese Fläche von der Messegesellschaft anderweitig vermietet werden (keine Belegung durch Austausch) dann hat der Aussteller 25% des Teilnahmebetrages, mindestens aber den Betrag nach Punkt 7, Absatz 1 der Besonderen Teilnahmebedingungen zu zahlen. Dem Aussteller bleibt der Nachweis vorbehalten, dass die von ihm verlangten Kosten zu hoch sind. Bei Nichtteilnahme eines Mitausstellers ist das Mitausstellerentgelt voll zu zahlen. Der Rücktritt und die Nichtteilnahme des Hauptausstellers führt gleichzeitig zum Ausschluss und Widerruf der Zulassung des Mitausstellers oder zusätzlich vertretenen Unternehmens. Wird die Eröffnung des gerichtlichen Insolvenzverfahrens über das Vermögen des Aus-stellers/Mitausstellers beantragt oder ein derartiger Antrag mangels Masse abgewiesen, ist die Messegesellschaft berechtigt, den Vertrag fristlos zu kündigen. Von dem Antrag des Verfahrens hat der Aussteller die Messe-co-exhibitor’s fee. If a co-exhibitor is admitted without the consent of Messe Düsseldorf, Messe Düsseldorf will have the right to cancel the contract with the main exhibitor without further notice and to clear the stand at the exhibitor’s cost. The exhibitor waives the rights of un-warranted interference. The exhibitor will have no right to claim damages. Co-exhibitors are all exhibitors who are represented on a stand with their own staff and own exhibits alongside the main exhibitor. Companies with close economic or organisational ties are also classified as co-exhibitors. Company representatives will not be admitted as co-exhibitors. Additionally represented companies are classified as those whose exhibits are shown by the exhibitor. Manufacturers of such equipment, machinery or other products_old which are necessary for the demonstration of an exhibitor’s products_old are not regarded as co-exhibitors or as additionally represented companies. In accordance with the admissions regulations co-exhibitors can be entered into the catalogue with their full address provided all fees have been paid and the necessary documents have been received by the specified deadline. Messe Düsseldorf can authorise group stands provided they are in keeping with the overall pattern of the event. Exhibitors on group stands are subject to all regulations. If a stand is allocated to two or more companies, each company will be jointly and severally liable to Messe Düsseldorf. Companies on a joint stand should nominate a common representative on the application form.

5 Cancellation and
non-participation

Applications can be withdrawn up until admission. A withdrawal fee (see Section 7 of the Special Conditions of Participation) plus sales tax is payable. Following admission, the exhibitor shall not be entitled to rescind the contract nor to reduce the stand area. The participation charges shall be payable in full together with any costs actually entailed. Should Messe Düsseldorf make alternative use of unoccupied areas to improve the general appearance of the show, the exhibitor who reserved the space shall not be released from his financial obligations. If the exhibitor decides not to occupy the stand space allocated to him, If the exhibitor decides not to occupy the stand space allocated to him, and this space can be rented to another party by the fair company (no occupation on swap basis), then the exhibitor must pay 25% of the participation charge, at least however the amount according to Item 7, Section 1 of the Special Conditions of Participation. The exhibitor reserves the right to furnish evidence that the costs required of him are too high. Should a co-exhibitor fail to participate, the co-exhibitor’s fee shall be payable in full. The cancellation and non-participation of a main exhibitor automatically results in the exclusion and cancellation of admission for the co-exhibitor. If insolvency proceedings are pending against an exhibitor’s assets, or if such proceedings have been suspended due to inadequate assets, Messe Düsseldorf shall be entitled to cancel the contract without further notice. Sont par ailleurs considérées comme entreprises représentées des entreprises dont les produits sont proposés par l’exposant principal sur le stand. Des fabricants d’appareils, de machines ou d’autres articles nécessaires à la démonstration de l’offre produits d’un exposant, et qui ne sont pas exposés, ne sont pas considérés comme coexposants. Les co-exposants peuvent, en raison des conditions d’inscription au catalogue, figurer dans le catalogue avec leur adresse complète s’ils s’acquittent du montant dû et s’ils envoient leurs demandes dans les temps impartis. Des stands collectifs plus grands peuvent être autorisés par Messe Düsseldorf, si toutefois ceuxci sont conformes à la thématique de la manifestation. Par ailleurs chaque exposant du stand collectif est soumis aux mêmes règles que les exposants individuels. Si un emplacement de stand est attribué à deux ou plusieurs firmes, chaque firme est considérée comme le débiteur principal. Les firmes exposant en collectif se doivent de nommer l’une d’entre elles comme représentant lors de l’inscription.

5 Retrait et
non-participation

Le retrait de l’inscription est possible jusqu’à l’admission. Il y a lieu de régler un forfait correspondant au droit de retrait (se reporter au point 7 des conditions particulières de participation) plus TVA. Après réception de l’avis d’admission, l’exposant ne pourra plus retirer son inscription, ni demander une réduction de la surface de son stand. La totalité du montant correspondant à la participation et aux prestations effectivement réalisées est à payer. L’échange par Messe Düsseldorf de surfaces non occupées à des fins de maintien de l’optique de la manifestation ne dégage en rien l’exposant de ses obligations de paiement. Si l’exposant renonce à occuper la surface de stand qui lui avait été attribuée et si le salon peut louer cet espace à un autre participant cet espace (sans qu’il y ait un échange de stand), l’exposant devra payer 25 % du montant de la participation, au moins, en tout cas, la somme prévue au point 7, alinéa 1, des conditions particulières de participation.
